EXCLUSION OF LIABILITY, RELEASE AND ASSUMPTION OF RISK

In exchange for being able to attend or participate in the event (including acting as an event official), I agree:

– to release Australian Auto-Sport Alliance Pty. Ltd. (AASA), promoters, sponsor organisations, land owners and lessees, organisers of the event, their respective servants, officials, representatives and agents (collectively, the “Associated Entities”) from all liability for my death, personal injury (including burns), psychological trauma, loss or damage (including property damage) (“harm”) howsoever arising from my participation in or attendance at the event, except to the extent prohibited by law.

– the AASA and the Associated Entities do not make any warranty, implied or express, that the event services will be provided with due care and skill or that any materials provided in connection with the services will be fit for the purpose for which they are supplied; and

– to attend or participate in the event at my own risk.

I acknowledge that:

– I will carry my AASA Media Licence or AASA Media Authorisation Letter at all times whilst conducting Media Operations, and produce it on demand to event/AASA officials
– Seek out and meet the Clerk of Course prior to the commencement of the event proper
– Attend each Media Briefing and each other briefing to which I may be directed. If no Media Briefing is scheduled, I will seek out and meet the Clerk of Course prior to the commencement of the event proper
– Wear a Hi-Vis tabard during all Media Operations
– Identify each of my equipment packs/bags with my name and mobile phone number
– Conduct my operations in such a way as to minimise any distraction to competitors
– Remain behind the First Line of Protection at a licenced racetrack/circuit
– Remain in an area protected by natural features or installed barriers at Closed or Off Road events; or
– Remain at least 15m from the edge of the road or designated/marked track at Off Road events when in an area with no natural or installed lines of protection. I acknowledge that this is only permitted when
competition vehicle speeds are less than 100km/h
– Comply with all instructions issued by Event Officials; whether written or verbal
– Make available to Event Organisers and/or the AASA a copy of any or all recorded media upon request
– Withhold publication of any or all recorded media from the event at which I am operating upon request by Event Organisers and/or the AASA
– Comply with all relevant protocols contained in AASA Appendix 10 – Media Policy
– Comply with any additional limitations/requirements specified by the Event Organiser
– the risks associated with attending or participating in the event include the risk that I may suffer harm as a result of:
– motor vehicles (or parts of them) colliding with other motor vehicles, persons or property;
– acts of violence and other harmful acts (whether intentional or inadvertent) committed by persons attending or participating in the event; and
– the failure or unsuitability of facilities (including grand-stands, fences and guard rails) to ensure the safety of persons or property at the event.
– motor sport is dangerous and that accidents causing harm can and do happen and may happen to me.

I also acknowledge and agree that I have been fully instructed in my duties and am familiar with the activities associated with being a AASA Media accredited person. I understand that this disclaimer is not intended to exclude
any valid claim by an official under the AASA Personal Accident Insurance Scheme

I declare that I am medically and physically fit and free from impairment and able to carry out normal duties expected of the position of media held at the Event.

I am willing to submit myself to the controls and restrictions applied to all officials at the Event.


I also acknowledge and agree that any media (including but not limited to photography, video, words, articles, etc) will be supplied to the event promoter within 3 business days from the completion of the event.

I also acknowledge that any material may be used by the promoter for advertising, social media, etc. And, any such media will not be sold or made available to 3rd parties without the consent of the author.

• that AASA and the Associated Entities do not make any warranty, implied or express, that the event services will be provided with due care and skill or that any materials provided in connection with the services will be fit for the purpose for which they are supplied; and to attend or participate in the event at my own risk.

COMMUNICABLE DISEASE EXCLUSION

1. Notwithstanding any provision to the contrary within this policy, this policy does not cover all actual or alleged loss, liability, damage, compensation, injury, sickness, disease, death, medical payment, defence cost, cost, expense or any other amount, directly or indirectly and regardless of any other cause contributing concurrently or in any sequence, originating from, caused by, arising out of, contributed to by, resulting from, or otherwise in connection with a Communicable Disease or the fear or threat (whether actual or perceived) of a Communicable Disease.

2. For the purposes of this endorsement, loss, liability, damage, compensation, injury, sickness, disease, death, medical payment, defence cost, cost, expense or any other amount, includes, but is not limited to, any cost to clean-up, detoxify, remove, monitor or test for a Communicable Disease.

3. As used herein, a Communicable Disease means any disease which can be transmitted by means of any substance or agent from any organism to another organism where: 3.1. the substance or agent includes, but is not limited to, a virus, bacterium, parasite or other organism or any variation thereof, whether deemed living or not, and

3.2. the method of transmission, whether direct or indirect, includes but is not limited to, airborne transmission, bodily fluid transmission, transmission from or to any surface or object, solid, liquid or gas or between organisms, and

3.3. the disease, substance or agent can cause or threaten bodily injury, illness, emotional distress, damage to human health, human welfare or property damage.

I acknowledge that:

• the risks associated with attending or participating in the event include the risk that I may suffer harm as a result of:

• motor vehicles (or parts of them) colliding with other motor vehicles, persons or property;

• acts of violence and other harmful acts (whether intentional or inadvertent) committed by persons attending or participating in the event; and

• the failure or unsuitability of facilities (including grand-stands, fences and guard rails) to ensure the safety of persons or property at the event.

• motor sport is dangerous and that accidents causing harm can and do happen and may happen to me.

I also acknowledge and agree that I have been fully instructed in my duties and am familiar with the activities associated with being an official. I understand that this disclaimer is not intended to exclude any valid claim by an official under the AASA Personal Accident Insurance Scheme. I will at all times remain behind the protective barrier provided unless directed otherwise by my senior officials, or if my specific duties require it, and then only for the minimum time required to carry out those duties.

I declare that I am medically and physically fit and free from impairment and able to carry out normal duties expected of the position I will hold at the Event.

I am willing to submit myself to the controls and restrictions applied to all officials at the Event.

I agree to provide my Working with Children Check (WWCC) details when requested and maintain a valid a card at all times whilst performing my duties as an official.

I accept the conditions of, and acknowledge the risks arising from, attending or participating in the event and being provided with the event services by AASA and the Associated Entities

(AASA), promoters, sponsor organisations, land owners and lessees, organisers of the event, their respective servants, officials, representatives and agents (collectively, the “Associated Entities”) from all liability for my death, personal injury (including burns), psychological trauma, loss or damage (including property damage) (“harm”) howsoever arising from my participation in or attendance at the event, except to the extent prohibited by law;

• that AASA and the Associated Entities do not make any warranty, implied or express, that the event services will be provided with due care and skill or that any materials provided in connection with the services will be fit for the purpose for which they are supplied; and to attend or participate in the event at my own risk.
